Telangana High Court had dismissed a civil revision petition filed by M/s Villa Springs House Owners Welfare Association at Kowkur claiming that 360 square yards of a plot of one of the villa owners was meant for public utility or common amenities.
The verdict was pronounced by Justice T. Vinod Kumar after hearing the plea filed by the association represented by its secretary, retired colonel G.R.R. Reddy. The villa developers purchased 8.20 acres at Kowkur of Alwal mandal in Medchal Malkajgiri district from the original land owner B.M. Muthyalu and constructed 110 villas. A housewife, V. Mounika Devi, purchased 2.05 acres adjacent to the villas from the same land owner.
The dispute began when the adjacent landowner started building a compound wall, prompting the villa association to object. According to the association, it had signed a memorandum of understanding in 2015 with developer Mounika Devi and the original landowners, allowing it to use three plots measuring 360 square yards for staff quarters and recreational use.
The association initially secured an injunction against Mounika Devi over the land. However, she challenged it in the district court, which overturned it. The association then filed a civil revision petition (CRP), challenging the district court’s order.
Dismissing the CRP, the judge ruled that the association had no absolute ownership over the disputed land and had not submitted any sanctioned layout to support its claim. As per the agreement, the land was only to be used until Mounika Devi received construction approval.
The order of the district court setting aside the lower court order did not suffer from any infirmity of the law, the judge said, dismissing the plea.
